The statement is intended to support legal actions and other measures against a state of emergency to force the administration to provide a legal and factual justification of the decision.

“No conclusive assessment of the facts confirms that there really exists a state of emergency, allowing the President to use money allocated for other needs, for the construction of a wall on the southern border” – think of the person signing the document.

The statement was also signed by Eliot Cohen, who worked in the state Department under President George Bush, Jr., Thomas R. Pickering, who served as Ambassador to the UN under President George H. W. Bush, John F. Kerry, who served as Secretary of state under President Barack Obama, Susan rice, Obama’s adviser for national security, Leon Panetta, while Obama led the CIA and the defense Department, and a number of other officials working in the field of intelligence and national security in democratic and Republican administrations.

In the 11-page statement cites various arguments in favor of the fact that the state of emergency is not justified. In particular, it says that the number of illegal border crossings is at its lowest level for almost 40 years. As claimed by the signatories with reference to the statistics of the Ministry of internal security, the number of undetected cases of illegal crossing of the border from 2006 to 2016, decreased from 851 000 to about 62 000.

In addition, according to the statement, contrary to the assertions of the President, on the southern boundary there are no documented emergency in connection with terrorism or crime.

The signatories also believe that the fight against drugs also, there is no emergency, which could be addressed through the construction of the wall, because, according to the justice Ministry, “the vast majority of opioid drugs” that fall in the United States, are imported through legal entry points.

The statement also says that the redistribution of funds from the budget the Declaration of a state of emergency will negatively affect the US interests in the sphere of national security and foreign policy.

The decision trump has also drawn criticism from former 23rd congressional Republicans who have signed an open letter urging them to adopt a joint resolution on the termination of a state of emergency. According to them, trump acted to bypass Congress.
