Today, the CAS rejected the appeals of 47 of the Russians, which the IOC was not allowed for the Games in 2018. The “SE” brings the text of the verdict in its entirety.

Lausanne, 9 Feb 2018. Ad Hoc panel of the court of arbitration for Sport (CAS) rejected an appeal filed on 6 February 2018 32 Russian athletes against the International Olympic Committee (IOC). It also dismissed an appeal filed by February 7, 2018, vs IOC 15 Russian athletes and coaches.

The applicants challenged the decision of the IOC not to invite them to participate in the Winter Olympic games of 2018 and requested CAS to refute the decision of the IOC.

In its decision, the CAS arbitrators considered that the IOC established the procedure for issuing invitations to the Russian sportsmen for performances as “Olympic athletes of Russia” (OAR), can be described rather as a decision for admission, but not the sanction. Despite the suspension of the Russian Olympic Committee, the IOC still give individual athletes the opportunity to participate in the Olympic games under certain conditions. This procedure was created to balance the interests of IOC in the global fight against doping and the interests of individual sportsmen from Russia.

At the hearing, the applicants acknowledged that the IOC had the authority to create such a procedure. The panel of arbitrators of the CAS established that the applicants are unable to demonstrate that two independent IOC (IRP and OARIG) conducted assessments of their applications, using discriminatory or unjust principles. The panel also concluded that there is no evidence that the IRP was incorrect or OARIG implement their decisions.

The parties were heard by the Panel in the office of the CAS ad hoc in Pyeongchang on 7 and 8 February 2018. Russian athlete Elena Nikitina and Tatyana Ivanova called for hearing on February 8. Mr. g√ľnter Younger, head of Department of investigation of WADA and a member of the IRP, gave testimony about how his Commission has established criteria for the invitation and the methodology used.
